Maine Divorce Laws on Property Division

The court will set aside each spouse's separate property and will divide the marital property fairly, considering the following relevant factors:1. The contribution of each spouse to the acquisition of the marital property, including the contribution of a spouse as a homemaker;
2. The value of the property set apart of each spouse;
3. The economic circumstances of each spouse at the time the division of property is to become effective, including the desirability of awarding the family home or the right to live in the home for reasonable periods to the spouse having custody of the children.

All property acquired by either spouse subsequent to the marriage is marital property, except:1. Property acquired by, or in exchange for property acquired by, gift, bequest, devise, or descent;
2. Property acquired by a spouse after a decree of legal separation;
3. Property excluded by valid agreement of the parties; and
4. The increase in value of property acquired prior to the marriage and the increase in value of any of the property described above.
