What to Expect When Help Yourself Divorce Prepares Your Kansas Divorce
Grounds for Divorce.
When Help Yourself Divorce prepares your divorce papers, your divorce will be granted based on the grounds of incompatibility.
Residency Requirements.
At least one spouse must have been a resident of the state of Kansas for 60 days immediately before filing the papers.
Filing for Divorce.
The petition can be filed in the Kansas county where either spouse lives.****NOTE**** We ARE NOT ABLE to prepare divorce papers for Coffey County, Kansas.
Service.
You are required to prove to the court that you served your spouse with copies of all the divorce papers. The way you provide service is by mailing or hand-delivering a copy of the papers to your spouse. Your spouse will then sign a form called an Entry of Appearance and Waiver of Service, and file this form with the court. This form tells the court that your spouse received the papers, and serves as proof of service.
Waiting Period.
After filing the papers with the court, there is a 60 waiting period before your divorce can be finalized.
Final Hearing.
Your divorce will be finalized during a brief uncontested divorce hearing, which only the Petitioner must attend. Your spouse can attend if desired, but he or she is not required to.
