General Qualifications.
We can help you if you meet the qualifications listed on our website. Essentially this means:
- You and your spouse must already have an agreement regarding all the issues of your divorce (property division, alimony, child custody if applicable, and so on)
- You must both be willing and able to cooperate and sign the paperwork
- You must both be willing to attend any required court appearances
- You must meet the specific requirements in your state regarding residency and any other specifics.
The Filing Process.
Once you get the papers, all you and your spouse have to do is sign and file them. The specific process will just depend on the procedure in your state and county, but don’t worry because we provide you with complete, step-by-step instructions along with your paperwork. However, this is what you can generally expect:
- Print the papers from your computer.
- Each spouse signs them.
- Take them to the courthouse and pay the filing fee (generally around $100-400, depending on where you file).
- In some cases, you may need to ”serve” your spouse by mailing or hand-delivering a copy of the papers. Rarely, formal service using a Sheriff or process server may be required. Check your state’s link at the right to confirm this.
- Wait for your divorce to be finalized. In some states, this means you must attend a brief uncontested divorce hearing, while others simply mail your papers back to you when they are ready, with no court appearances required. Most of the time, when a hearing IS required, only one spouse is required to attend. Again, check your state’s link at the right, or contact the clerk of the court in your county, to confirm this.
